For the past two years we’ve been following the state of Kentucky’s moves in the courtroom dealing with “illegal gambling operations.” In short, the state filed a complaint against several poker online room operators and threatened to seize 141 domain names as “tools that aid in illegal poker gambling activity.”

On March 19th, 2010 the case was finally heard by the state’s Supreme Court. Only, it wasn’t really heard, it was just appealed to for it’s opinion on standing. There are two main companies in the middle of this whole mess, Imega Gaming and Interactive Gaming Council. The ruling was in favor of the two companies, but it’s only temporary.

The court opined that these two entities did not have standing to litigate on behalf of the anonymous domain registrants, however they were given 20 days to refile in appeals court. The only caveat was that someone from the domain had to present an affidavit that he was a member of one of the associations (either IMEGA or ICG) and could therefore be represented by them.

Joe Brennan, Imega’s chairman, said, “We’re going to file it. There’s no question about that.” The upside to this is that if one case prevails, the rest of the domains and domain owners prevail as well.

As the chips have fallen, it seems that Kentucky got drawn out on at the river. “Numerous compelling arguments endorsing the grant of writ of prohibition (which would effectively make the state unable to seize the domains) have been presented. Although all such arguments have merit, none can be considered unless a presented by a party with real standing.”

Seems the Supreme court has been persuaded. Maybe we’ll be able to play poker freely eventually.
